TERMS AND CONDITIONS OF THE ELECTRONIC LOTTERY GAME ONLINE AND IN REAL TIME "TUSAMI"

Finally, access to the Service may occasionally be suspended or restricted for the purpose of performing repair or maintenance work, or introducing new products or services. We will endeavor to limit the frequency and duration of such suspensions or restrictions.

2. DEFINITIONS

For the purposes of these Terms and Conditions, the following terms will be used:

• Consorcio Viettel Perú Lotteries: Made up of the companies Viettel Perú SAC and Bitel Loterías SAC whose object and purpose is to carry out the operation of lottery games with the Sociedad de Beneficencia del Cusco (hereinafter, "SBC ").
• Viettel Perú SAC: Legal entity that has a concession contract to provide public telecommunications services. Hereinafter it will be referred to as "Bitel".
• Customer Service Department: Department in charge of Viettel Perú SAC that deals with queries related to the Service and coordinates regarding the collection of the prize. Customers of Viettel Perú SAC may be contacted, free of charge, by dialing 123 or 930277777. Customers of other operators may be contacted, for a fee, by dialing 930277777.
• Ticket : It is the receipt that is issued when playing on the website and contains one or more plays chosen by the user. In addition, it allows the user to collect the prize if he is a winner.
• Electronic lottery game online and in real time: It consists of a game through which the user chooses a combination of numbers at his discretion, guaranteeing the sending of data to an online central office in real time.
• User: Natural person over 18 years of age, with the capacity to exercise, who has registered and logged into the website and participates in the Service.
• Bitel Client: Bitel Client with Prepaid, Postpaid or Control lines active bidirectionally, that is, they can make and receive calls.

Next, you must click on "Get verification code" and you will receive an SMS with the verification code (OTP Code), which you must enter in the "Verification code" field. Then, you must read and accept these Terms and Conditions and click on the "Continue" button.

Subsequently, you must complete the form with your personal data (full names and surnames, ID / CE / Passport, date of birth, email, among others). Finally, the user will have to create and enter their password.

• ABOUT THE LOGIN :

The user You must enter the website https://tusami.bitel.com.pe . Then, you must click on the "Login" button, enter your phone number with which you registered and enter your password. Finally, you must click on the "Login" button.

4. MODES OF ACCESS TO THE SERVICE

• THROUGH THE WEBSITE :         

Once registered in the Service, the user must enter the website https://tusami.bitel.com.pe . Then, you must choose the game of your choice, click on the "Play now" button and select the numbers for the game (the number of numbers varies according to the game chosen) or click on the "Random Play" button. There are 3 game modes:

• TUSAMI DIARIO:
  • All natural persons over the age of 18 residing in Peru may participate.
  • The cost for participation is S/1.50 (Inc. IGV).
  • The game consists of choosing 7 different numbers from a total of consecutive numbers from 1 to 45. Additionally, you can choose 1 number between 1 and 2, which will be called "La Poderosa".
  • The jackpot amounts to S/200,000.00 (Two hundred thousand and 00/100 soles), which will increase according to the sale of tickets .
  • To win the jackpot, the user must match the 7 numbers of the winning result. Additionally, you must hit "The Powerful".
  • The game is daily, so it starts at 06:00 pm and the results are shown at 06:15 pm the next day.

• TUSAMI SEMANAL :
  • All natural persons over the age of 18 residing in Peru may participate.
  • The cost for participation is S/5.00 (Inc. IGV).
  • The game consists of choosing 6 different numbers from a total of consecutive numbers from 1 to 46. Additionally, you can choose 1 number between 1 and 2, which will be called "La Poderosa"
  • The jackpot amounts to S/2'000,000.00 (Two million and 00/100 soles), which will increase according to ticket sales.
  • To win the jackpot, the user must match the 6 numbers of the winning result (without considering "La Poderosa").
  • The draw is held twice a week: Monday and Thursday. For the draws on Monday , it starts every Thursday at 06:15 pm, it closes at 05:45 pm on monday and the results are published at 06:15 pm every monday. And for the draws on Thursday , it starts every Monday at 06:15 pm, it closes at 05:45 pm every thursday and the results are published at 06:15 pm every thursday.

• TUSAMI MILLONARIO :
  • All natural persons over the age of 18 residing in Peru may participate.
  • The cost for participation is S/5.00 (Inc. IGV).
  • The game consists of choosing 5 different numbers from a total of consecutive numbers from 1 to 70. Additionally, you can choose 1 number from a total of consecutive numbers from 1 to 25, which will be called "The Powerful".
  • The jackpot amounts to S/8'100,000.00 (Eight million, one hundred thousand and 00/100 soles), which will increase according to ticket sales .
  • To win the jackpot, the user must match the 5 numbers of the winning result. Additionally, you must hit "The Powerful".
  • The game is weekly, so it starts every Friday at 06:00 p.m. and the results are shown on Friday of the following week from 06:00 p.m. to 07:00 p.m.

6. RECHARGES

The user may participate in the Service as long as they have an available balance in their account.

In the event of any of the following events, the user's account may be restricted or cancelled:

- For the illegal use of one or more debit or credit cards associated with any account in the Service.

- For not accrediting the ownership of the debit or credit card associated with any account in the Service.

• Through a Bitel store:

The user must go to any Bitel store, indicate their cell phone number and the amount to be recharged. Finally, you will receive an SMS or an email indicating the amount of the recharge made.

• Through the purchase of TuSami packages:

This recharge method is exclusive for those Bitel customers who purchase the TuSami packages: TS3, TS5, TS7, TS10 and TS20. To buy any of the aforementioned packages, the user must send an SMS to 164 with the package code of their choice or enter the "Packages" section of the Mi Bitel App.

Once the recharge has been made, the user will not be able to request a refund of the amount of said recharge.

7. AWARDS

• PRIZES OF TUSAMI DIARIO :

In this modality there are 8 levels of prizes, as detailed below:

(*) The jackpot will increase according to the daily ticket sales.

(**) The prizes are subject to the Tax on games, which represents 10% of the total value of the prize.

• • Levels 1, 2 and 3 will deliver the prizes by check or transfer. If there is more than one winner per level, the prize will be distributed proportionally among the winners.
  • Levels 4, 5, 6, 7 and 8 will deliver the prizes individually to each winner, said prizes will be automatically credited to each winner's virtual wallet.

• PRIZES OF TUSAMI SEMANAL

In this modality there are 8 levels of prizes, as detailed below:

The indicated prizes may be modified at any time, prior communication to the SBC. Any modification will be reflected in these Terms and Conditions.

The user may participate in more than one game modality, being able to win in more than one.

In any type of game, the winner will only receive 1 prize, which will be the one with the highest correct answers in a play. This makes it impossible for the winner to collect additional prizes at lower levels.

8. DRAW OF NUMBERS

The draw of the numbers will be carried out through the RNG system ( Random number Generator ) that will provide the numbers of balls chosen by the user according to the chosen game mode.

Once the results have been obtained, they will be validated before a Notary Public attesting to the authenticity of the winners. Finally, the winners will be published on the website https://tusami.bitel.com.pe .

9. PRIZE PAYMENT

Prizes are classified into three types: Minor Prizes, Medium Prizes and Major Prizes.

• MINOR PRIZES :
• • Corresponds to amounts less than S/1,000.
  • Users will receive an SMS or email with a winning ticket code .
  • These prizes will be charged to your digital wallet automatically. If you do not have an account, you must first register to view it.
  • Prizes with an amount less than S/20 may only be used to play in the Service.
  • Prizes with an amount greater than or equal to S/20 may be withdrawn from the virtual wallet, upon request of the winner. To do this, the winner must contact the Customer Service department. Payment will be made within a period of no more than 15 business days, counted from the day the documentation was validated.
  • The form of payment will be made in cash or transfer.

• MEDIUM PRIZES :
• • Corresponds to amounts greater than or equal to S/1,000 and less than S/200,000.

  • Payment will be made within a period of no more than 15 business days, counted from the day the documentation was validated.
  • The form of payment will be made by check or transfer.

• GRAND PRIZES :
• • Corresponds to amounts greater than or equal to S/200,000.
  • Users will receive an SMS or email with a winning ticket code .
  • Payment will be made within a period of no more than 60 business days, counted from the day the documentation was validated.
  • The form of payment will be made by check or transfer.

10. CONTACT THE WINNERS OF THE DRAW

1. For minor prizes (greater than or equal to S/20):

After the first communication made by the winner to the Customer Service department, the winner will receive a second call in which the following information will be requested: Full names and surnames, identity document number (DNI/CE/Passport), interbank account (CCI), email and address. This, in order to validate the identity of the winner. Said documentation must be sent to the following email tusami@bitel.com.pe .

Prizes will be awarded according to the following:

In case the winner resides in Metropolitan Lima or Callao :

If the winner resides in Lima, they must go to the main office of Viettel Perú SAC (Calle 21, N° 878, district of San Isidro, province and department of Lima) with the necessary documentation for validation:

• • Identity document (DNI/CE/Passport) original and copy
  • ticket code
  • Interbank account number of a financial institution in Peru, which must be under your ownership.

In case the winner resides in the province:

If the winner resides in the province, they must go to a Viettel Perú SAC store, which will be previously indicated via email, with the necessary documentation for validation:

• • Identity document (DNI/CE/Passport) original and copy.
  • ticket code
  • Interbank account number of a financial institution in Peru, which must be under your ownership.

Finally, once the prize has been delivered, the winner must sign the document called “Prize delivery certificate”.

2. For the medium and major prizes:

The Customer Service department will contact the winners by telephone and request the following information: Full names and surnames, identity document number (DNI/CE/Passport), interbank account (CCI), email and address. This, in order to validate the identity of the winner. Said documentation must be sent to the following email tusami@bitel.com.pe .

Up to 5 calls will be made (1 call per day). If the winner does not answer any of the calls made, they will have a period of 60 calendar days, counted from the date of the draw, to request delivery of the prize, otherwise the prize will be forfeited.

In case the winner resides in Metropolitan Lima or Callao :

Finally, once the prize has been delivered, the winner must sign the document called “Prize delivery certificate”.

In any of the aforementioned cases, if the winner cannot come to collect the prize on the agreed date and time due to a fortuitous event or force majeure -after evaluating the requirements required by law- he may designate a representative, for the purposes of that he can collect it on your behalf. To do so, the representative must present the following documents:

11. PROMOTIONS

The promotions listed below are valid for all users of the Service, which are valid from April 12, 2023 to September 12, 2023.

• REFERRAL PROGRAM :
  • All users will be able to send their referral code (cell phone number) to their friends to invite them to register for the Service.
  • Once the referrals have registered by entering the code provided by the user, both will receive a S/5 bonus.
  • Additionally, if the users are Bitel clients, they will receive a bonus of 1GB in High Speed.
  • The S/5 bonus will be valid for 30 calendar days, counted from the day the referral registered.
  • The 1GB High Speed bonus will be valid for 3 calendar days, counted from the day the referral registered.
  • Maximum number of invitations per month is 5 times where they can receive this benefit for the referral and referrer.

• WELCOME BONUS:
  • All new users who register on the Service website will receive a bonus of S/ 10.
  • The bonus will be automatically charged to the user's virtual wallet, which will be valid for 7 calendar days, counted from the day the user registered.

12. ASSIGNMENT OF PERSONAL DATA RIGHTS

Contestants expressly acknowledge that, if chosen as a winner, they grant the irrevocable right to Bitel Loterías SAC to assign free of charge: their full names and surnames, National Identity Document number (DNI), telephone number, email, address, voice and image, so that they appear in publications, advertising media and, in general, in all disclosure material of the Service's activities; such as delivery, receipt and enjoyment of the prize, testimonials, either during the promotional period or once it has expired, without implying the right to receive any consideration, or generating claims for image and/or voice rights, which will be assigned. only for the purpose of disclosing the results and accreditation of the Service prizes.

13. PRIVACY POLICY AND PROCESSING OF PERSONAL DATA

14. JURISDICTION AND COMPETENCE

Peruvian law and may be submitted to the Courts and Judges of the District of Lima. The user waives any other law to which application may be entitled. The parties expressly waive any other jurisdiction that may correspond.

15. INTERPRETATION

Bitel Lotteries SAC will apply, in the face of any situation foreseen or not foreseen in these Terms and Conditions, the provisions contained in Law No. 29571, Consumer Protection and Defense Code (and its amending regulations) and the Civil Code (and its amending rules); without prejudice to reserving the right to make any type of modification regarding the validity of the Service, and any other situation related to the Service, in accordance with current regulations.

By using the Service, the user accepts these Terms and Conditions, as well as future modifications that Bitel Loterías SAC may make.
